These Terms and Conditions (“Terms”) govern your use of this website and any orders placed for products or services. By placing an order with us, you agree to be bound by these Terms.

2. SCOPE AND ACCEPTANCE

Orders are subject to these Terms. A binding contract is formed when we confirm your order by email and receive full payment.

3. PRODUCT INFORMATION

We endeavour to provide accurate descriptions of our products. However:

  • Colours may vary due to screen/display settings.
  • Handmade or custom products may differ slightly from images.
  • Product dimensions and materials are approximate unless otherwise stated.

These variations do not constitute defects under consumer law.

4. CUSTOM & PERSONALISED ORDERS

Your business revolves around customer-designed items (e.g., custom tees, mugs, magnets). For custom items:

  • By submitting artwork, text, or instructions, you confirm correctness of spelling, layout, artwork and sizing.
  • We are not liable for mistakes you approve.
  • Custom/personalised goods are not eligible for cancellation or return once production begins, except if faulty or not as described.
  • Under the EU Consumer Rights Directive 2011/83/EU, personalised goods are exempt from the 14-day cancellation right. This means once personalised production has started, you do not have a statutory right to cancel your order.

5. PRICE & PAYMENT

  • All prices are in Euro (€) and include applicable VAT.
  • Payment is due in full prior to production.
  • We reserve the right to correct pricing errors prior to order confirmation.
  • Accepted payment methods: Visa, MasterCard, Revolut Pay, Bank Transfer

6. ORDER PROCESSING

We may refuse or cancel an order for reasons including:

  • Suspected fraud,
  • Offensive/copyright infringements in supplied artwork,
  • Supply chain or stock limitations.

You will be notified if this occurs.

7. INTELLECTUAL PROPERTY

By uploading images or artwork, you warrant you have the legal right to use them. We are not responsible for infringement of third-party trademark or copyright rights resulting from customer-supplied content. All original designs created by us are our intellectual property.

8. DELIVERY & RISK

Estimated delivery times are indicative and not guaranteed.

Delivery costs and methods will be as specified at checkout.

Risk in products passes to you upon delivery to the address you provided. You are responsible for providing accurate delivery information.

9. FAULTY OR INCORRECT GOODS

If goods are faulty, not as described or incorrect, you may be entitled to repair, replacement, or refund under the Sale of Goods and Supply of Services Act 1980. You must notify us within 48 hours of delivery with clear photographic evidence.

Faults due to misuse, improper care, or normal wear do not qualify.

10. CARE INSTRUCTIONS

Products should be cared for in line with provided instructions. Damage due to incorrect washing, heat exposure, or misuse is not covered by refunds or replacements.

11. LIMITATION OF LIABILITY

Our total liability for any claim arising shall not exceed the value of your order. We are not liable for indirect or consequential losses to the extent permitted by Irish law. Nothing in these Terms limits liability for death, personal injury, or fraud.

12. DATA PROTECTION

We process personal data according to GDPR and the Data Protection Act 2018. Please refer to our Privacy Policy for details about data use, storage and rights.

13. FORCE MAJEURE

We are not liable for failure to perform due to events beyond our control, such as supply delays, natural events, or postal disruptions.

14. GOVERNING LAW

These Terms are governed by the laws of Ireland. All disputes shall be dealt with exclusively by the Irish courts.

We may update these Terms from time to time. The version applicable at the time of your order will apply.

17. CHILD USE & SAFETY NOTICE

Unless explicitly stated otherwise, products sold by Imaginarium Enclave are not designed, tested, or certified for use by children. Our products are decorative, apparel, or novelty items, not toys. They are not intended for use by children under 14 years of age. Items are not suitable for babies, toddlers, or young children. Parents or guardians who permit use by minors do so entirely at their own discretion and risk.

18. SMALL PARTS & CHOKING HAZARD

Some products may include:

  • Small components
  • Printed embellishments
  • Packaging materials

These may present a choking or suffocation hazard.

⚠ WARNING: Not suitable for children. Keep out of reach of children. This warning applies particularly to:

  • Packaging materials
  • Printed accessories
  • Magnets, decals, tags, or attachments

19. PACKAGING SAFETY

All packaging is intended for transport only and should be:

  • Removed immediately upon receipt
  • Kept away from children
  • Disposed of responsibly

Packaging materials are not toys and pose a risk of suffocation or injury.

20. WEARER RESPONSIBILITY (APPAREL)

Where apparel items (e.g. T-shirts, hoodies) are worn by minors:

  • Adult supervision is required
  • Correct sizing must be ensured
  • Products must be used as normal clothing only

We accept no liability for misuse, alteration, or use outside intended purpose.

21. DISCLAIMER REGARDING MEDICAL & SAFETY STANDARDS

Our products:

  • Are not medical devices
  • Are not safety-certified protective equipment
  • Are not children’s toys under EU Toy Safety Directive (2009/48/EC)

They are intended solely for general consumer and decorative use.

22. LIMITATION OF LIABILITY – CHILD USE

To the maximum extent permitted by Irish law:

We disclaim liability for injuries or harm resulting from use by children. Responsibility rests with the supervising adult or guardian. This does not affect statutory consumer rights.
